Terms of Service

These Terms of Service ("Terms") govern your access to and use of the products, services, and platform provided by Introspection AI, Inc. ("Introspection," "we," "us," or "our"), including the Introspection platform, APIs, agents, and related tools (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms.
1. Definitions
- "Customer Data" means all data, content, traces, logs, and other materials that you submit to the Services. Customer Data does not include Usage Data.
- "Usage Data" means anonymized, aggregated data about how the Services are used, including feature usage, performance metrics, and error rates.
- "Authorized Users" means individuals you authorize to access the Services under your account.
2. Access and Use
Subject to these Terms, we grant you a non-exclusive, non-transferable right to access and use the Services for your internal business purposes during your subscription term.
You agree not to:
- Reverse engineer, decompile, or disassemble any part of the Services.
- Use the Services to build a competing product or service.
- Share account credentials or allow unauthorized access.
- Use the Services in violation of applicable laws or regulations.
- Interfere with or disrupt the integrity or performance of the Services.
- Transmit any malicious code, viruses, or harmful content through the Services.
You are responsible for all activity under your account and for ensuring that Authorized Users comply with these Terms.
3. Customer Data and Intellectual Property
Your Data
You retain all rights to your Customer Data. You grant us a limited license to use Customer Data solely to provide and operate the Services on your behalf.
We do not use Customer Data to train AI or machine learning models.
Our Services
We retain all rights to the Services, including all software, technology, and intellectual property. Nothing in these Terms transfers ownership of any Introspection intellectual property to you.
Usage Data
We may collect and use Usage Data to improve, maintain, and develop the Services. Usage Data is anonymized and aggregated and cannot be used to identify you or your Authorized Users.
Feedback
If you provide suggestions, ideas, or other feedback about the Services, we may use that feedback without restriction or obligation to you.
4. Security and Privacy
We implement commercially reasonable security measures to protect Customer Data. Our security practices include encryption in transit and at rest, private networking, role-based access controls, and sandbox isolation for agent workloads.
You are responsible for obtaining any consents required to submit personal data to the Services. You agree not to submit sensitive personal data (such as government-issued identification numbers, medical records, or financial account numbers) to the Services unless you have an enterprise agreement that specifically permits it.
Our collection and use of personal information is described in our Privacy Policy.
5. Payment
Fees for the Services are described on our website or in your order form. All fees are stated in U.S. dollars and are non-refundable except as required by law or as otherwise specified in your subscription plan.
We may suspend access to the Services if payment is overdue. Usage- based charges (such as LLM token usage and compute) are billed in arrears based on actual consumption.
6. Confidentiality
Each party agrees to protect the other party's confidential information using at least the same degree of care it uses for its own confidential information, but no less than reasonable care. Confidential information does not include information that is publicly available, independently developed, or rightfully received from a third party without restriction.
Confidentiality obligations survive for five years after termination of these Terms, except for trade secrets, which are protected indefinitely.
7. Term and Termination
These Terms are effective when you first access the Services and continue until terminated. You may terminate your account at any time through the platform settings or by contacting us.
We may terminate or suspend your access if you breach these Terms and fail to cure the breach within 30 days of notice. Upon termination, your right to access the Services ceases and we may delete your Customer Data after a reasonable retention period (not less than 30 days).
8. Warranties and Disclaimers
We provide the Services on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non- infringement.
We do not warrant that the Services will be uninterrupted, error- free, or free of harmful components.
9. Limitation of Liability
To the maximum extent permitted by law, neither party will be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunity, arising out of or related to these Terms.
Our total aggregate liability under these Terms will not exceed the amounts you paid to us in the twelve months preceding the claim.
10. Indemnification
You agree to indemnify and hold Introspection harmless from any claims arising from your use of the Services, your Customer Data, or your violation of these Terms.
We will indemnify you against third-party claims alleging that the Services infringe a valid intellectual property right, provided you promptly notify us and give us control of the defense.
11. Dispute Resolution
These Terms are governed by the laws of the State of Delaware, without regard to conflict of laws principles. Any disputes arising under these Terms will be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration will take place in San Francisco, California.
Either party may seek injunctive relief in a court of competent jurisdiction to protect its intellectual property or confidential information.
12. General
- Entire agreement: These Terms, together with any order form or enterprise agreement, constitute the entire agreement between you and Introspection regarding the Services.
- Amendments: We may update these Terms by posting the revised version on our website. Material changes will be communicated with at least 30 days' notice.
- Assignment: You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
- Severability: If any provision is found unenforceable, the remaining provisions continue in effect.
- Waiver: Failure to enforce any provision does not constitute a waiver of that provision.
